NEW ORLEANS LAND RIGHTS. Examen des droits des États-Unis et des prétentions de Mr. Edouard Livingston sur la batture en face du Faubourg Ste. Marie. New Orleans: Thierry & Co., 1808. 4to (205 x 220 mm). Modern three-quarter morocco and cloth, matching slipcase, light rubbing to slipcase, heavy dampstaining to last several leaves, some paper losses to last leaf, with reinforcement at fore-edge in japan paper. In the years immediately following the Louisiana purchase there were a number of contentious political issues that arose from conflicts between Louisiana's prevailing laws and U.S. common law. Among them were 'batture rights,' the right to ownership of land that was formed from alluvial deposits on the river side of a levee. In 1807 attorney Edward Livingston claimed a portion of the batture, but the federal government argued that it constituted public land. This was one of several related cases that were contested in the courts, up to the U.S. Supreme Court, before a compromise was reached in 1820. 'On p 35 is a reference to copies of a plan to be annexed to the work. None of the located copies contain plans' (Sabin 95344).
