    • Auction
      Items are sold to the highest bidder at the auction on dedicated auction days, or previously notified. The auctioneer may change the order of lots as notified in the catalogue and has discretion to combine and divide lots. Should complaints emerge regarding the winning of an item, the auctioneer has discretion to resume the auction from the preceding bid.

      Viewing of the lots before auction
      All lots will be on display prior to auction, in the case of traditional auctions, or can be viewed by appointment for online auctions, in order to examine the quality and condition of items; no complaints will be accepted after the hammer, even if there are errors in the catalogue

Buyer's premium
The hammer price of an item is increased by 22% to the buyer, to include buyer's premium and VAT.

Note
Antique items declared of significant interest under art. 6 of Legislative Decree 29/10/99 no.490 are indicated as such in the catalogue or announced during the sale. On such items, the Italian State may exercise the right of first refusal within 60 days of the sale notice; the sale, therefore, will only take place after the deadline has passed. In the event that the right of first refusal being exercised, the bidder will be entitled to reimbursement of any amounts already paid.

Proxy bids
During the sale, the auctioneer may start the bidding from offers made by buyers who cannot attend the auction. Proxy bids can be made: - via fax to 0302054269, by sending the request form for a proxy bid with all fields completed and countersigned, together with a copy of your identity document.

Telephone bidding
For those who cannot be present in the room on the day of the auction there is also the opportunity to participate by telephone. When the lot approaches bidding time, a representative of the auction house will contact the interested party by phone, who will indicate the bids to be made.

Written, telephone and internet bids
For those who cannot attend the auction in person, Capitolium Art will be pleased to execute written, telephone or internet bids. Please note that this service is free of charge and Capitolium Art therefore accepts no responsibility for offers inadvertently omitted or errors in the execution of bidding, especially in the case of incorrectly completed, incomplete or illegible bidding forms.

All those who take part in the sale fully accept these regulations and upon acquiring any item assume legal responsibility for the purchase made. Any dispute will be the resolved by the Court of Brescia.

CapitoliumArt provides an all-inclusive service for packaging and shipping of lots for auction buyers.
- The service can be paid for in one transaction together with the purchased lots.
- For several lots, up to a maximum of four, with the exception of large sculptures and furniture items, these can be combined in a single package; in this case the shipping cost will be the lot with the highest shipping cost plus 5 euros for each additional lot.
- Insured shipping can also be provided on request.
- In the case of framed lots, the glass is always removed before shipment.

Export from the Italian territory: 
Export of lots outside the territory of the Republic of Italy, especially items more than fifty years old, is subject to regulations under Legislative Decree 29/10/99 no. 490 (art. 65-72). 
Issue of the relevant certificates for free circulation is the responsibility of the buyer.
Failure to provide or delay in the issuing of any licence does not constitute cause for termination or cancellation of the sale, or justify any delay in payment by the purchaser of the total amount due.

  • HOW TO PAY

Payments
Forms of payment accepted are: cheque, bank transfer, credit card (Visa, Mastercard and American Express) and cash up to €1,000.00. In the case of cheque or bank transfer, payment will be considered cleared only upon confirmation by our bank of transfer of the amount due. No item will be delivered prior to this. Payments for items purchased must be made no later than 5 working days from the date of the auction. In case of default by the buyer, the auction house will assume that the sale is closed and make the item available again to the seller.

Deferred payments
For purchases with a minimum €5,000.00 hammer price, auction fees excluded (for each individual auction, where more than one item is purchased), a deferred payment service is provided interest-free, with 5 monthly installments and immediate payment of the auction fees and first installment of the hammer price. To be eligible for deferred payment, you must notify the auction house in advance, indicating the lots in which you are interested. For information email: amministrazione@capitoliumart.it

Valuations
Capitoliumart provides valuations of works of art free of charge before they are offered for auction. A provisional valuation can be made from photographs, which can be sent:

All photographs must be accompanied by an indication of the size, author or presumed author, technique and potential date of execution and the presence or absence of documentation (authentication, provenance, publications, etc.) related to the work. Valuations may be carried out at the seller's home by appointment. The auction house will not be responsible for returning paperwork (documents and images) received.

Reserve price
A reserve price will be agreed before the auction; this is the minimum amount at which the lot can be sold. This figure is strictly confidential and will be secured by the auctioneer through appropriate bids. If the reserve price is not reached, the lot will be unsold.

Advance Payments
For commissions with a minimum value of €3,000.00, a cash advance is provided to the seller of up to 20%, calculated from the total of the reserve prices on a single sales mandate.   • DELIVERIES

Sales mandate
The sales mandate is the contract by which the owner of the property comprising one or more items gives the Auction House, CapitoliumArt, permission to sell those items according to the conditions contained therein. This contract is completed in duplicate upon consignment of the lots, the original remains at the auction house and the copy goes to the customer. Where items are consigned by courier the mandate must be completed in original and sent with the items. The customer copy will be sent to the customer later.

Commission
Commission payable to the auction house is 30% of hammer prices below €500 and 15% above €500.

Transport and insurance costs
Transport and insurance costs are paid by the customer. The cost of insurance is 1% calculated on the total of the reserve prices on the sales mandate for "nail to nail" cover. This is paid in advance by the auction house and deducted at the time of payment. In the case of lots not sold the insurance cost must be paid by the client before items are returned.

Resale right (Droit de suite)
For modern artworks subject to resale right, an additional percentage will be applied, calculated as follows: applicable work: original works of fine art such as paintings, "collages", drawings, engravings, prints, lithographs, sculptures, tapestries, ceramics, glass works, photographs and original manuscripts; copies of works of fine arts produced in limited numbers by the author or under authority fromthe author, provided they are numbered, signed or duly authorised by the author. Fees: the fee is calculated on the sale price, net of tax, on a percentage basis, which varies according to the different brackets, as follows: 4% for the portion of the sale price of between €3,000.00 and €50,000.00; 3% for the portion of the sale price of between €50,000.01 and €200,000.00; 1% for the portion of the sale price of between €200,000.01 and €350,000.00; 0.5% for the portion of the sale price of between €350.000,01 and €500,000.00; 0.25% for the portion of the sale price exceeding €500,000.00, subject to a maximum payment of €12,500.00.

Unsold lots
If requested by the customer, the auction house will put unsold lots to auction again at a leter date, on condition that the reserve prices are lowered. Otherwise these lots must be picked up within thirty days from the auction date at no additional charge. After this deadline storage costs will apply.

Payment methods
Items purchased can be paid for by cash (up to €1,000), bank transfer, cheque or bank draft.

Timing of payments
The auction house pays the seller once payment from the buyer has been fully cleared. Time of payment can therefore vary according to when payment is received. If payment is not received within 45 working days, the lot will be declared unsold.

  • PALAZZO CIGOLA FENAROLI VALOTTI

Brescia, city of ancient palaces: a property yet to be discovered.
This is an extraordinary opportunity: Palazzo Cigola - Fenaroli, located between Via Carlo Cattaneo and Piazza Tebaldo Brusato. This is one of the most significant; the two facades clearly reveal different periods: sixteenth century on the Via Cattaneo side, with a portal off-centre and featuring two imposing atlases, and seventeenth century on the Piazza Tebaldo Brusato side. The two sections blend harmoniously, however, both in terms of size and continuity of the sixteenth century modules into the seventeenth century section. Entering from Via Carlo Cattaneo you come to an elegant portico and then a courtyard dating back to the beginning of the sixteenth century - perhaps even the late fifteenth century - three of the sides having four supremely elegant bays above high piers. A staircase leading to the gallery is accessed from the portico, this takes the form of a closed loggia, with wood-panelled ceiling, carved roses and cornices, all in the style of sixteenth century Brescia. The ceiling of the adjacent hall is a prominent and rare feature for Brescia, real wooden coffers, richly carved and with a variety of motifs: a very unusual style not found in other buildings in the city, reminiscent of Fausto Lechi and the participation of craftsmen and artists from outside. An airy dining room decorated with three landscape paintings, enclosed by pilaster strips, representing - with artistic licence - three holiday resorts of the Cigolas in the province of Brescia. Other rooms have coffered ceilings, finely carved with decorations and frescoes by famous artists, including Sante Cattaneo and Carlo Frigerio. This magnificent building, built as mentioned in the sixteenth and seventeenth centuries by the Counts Cigola of Muslone, passed to the noble Fenarolis when the family died out. In the history of the noble family Cigola, tradition has it that Pierre du Terrail, the fearless and irreproachable knight of Baiardo, stayed and was cared for here after he was wounded in the sacking of 1512.
