LINCOLN LEGAL DOCUMENT. LINCOLN, ABRAHAM. 1809-1865. Autograph Document Signed ('Lincoln & Herndon'), a legal filing for George D. Berry, in the case against Cagle, seeking additional damages caused by Cagle's impregnating Berry's daughter Elizabeth, 2 pp, 4to (310 x 210 mm), ink on blue paper, Christian County Circuit Court, November term, 1849, old folds, window framed beneath a profile portrait of Lincoln to 710 x 435 mm. A FASCINATING LINCOLN PLEADING FOR DAMAGES WHEN A MAN'S DAUGHTER WAS RENDERED UNABLE TO PERFORM WORK FOR HIM BECAUSE SHE BECAME PREGNANT. In a rather unusual legal position, Lincoln was hired to represent George D. Berry in a suit for damages against John L. Cagle because his 'daughter and servant,' who Cagle had impregnated, was unable to perform her household duties and assist him, thus causing him injury. Further, after she was delivered of the child she was still unable to perform her services. In an interesting twist, Lincoln's mother Nancy was raised by Richard Berry, Jr., and she married Thomas Lincoln in the Berry house. Later, Lincoln opened unsuccessful mercantile stores in New Salem with William Berry. When Berry's drinking undermined their business, driving the stores into debt and Berry to an early grave, Lincoln assumed all of Berry's and the store's debts, working hard to repay every one. In the process, he earned the moniker that would follow him throughout his life, 'Honest Abe.' It is unclear whether George D. and Elizabeth Berry have any relation to the Lincoln-Berrys but it is an intriguing connection. See White, A. Lincoln: A Biography, 2009, pp 3-65.
